Japan Consumer Information Center (web) announced a report on April 21 that Japan has to introduce a system to make the enterprise that violated an illegal action pay back for an unjustified profit, reacting to the proposal of a society set up by its center.
The society expresses it is necessary to introduce a disciplinary claim for damage and a money sanction system in the report. The society is composed of four specialists. The title is "Legislation society to be paid back for undue profit by the illegal act in the consumers trade field".
Disciplinary punitive damages are one of the focuses of the argument in a compensation lawsuits by the victims of a January 2002 fatal accident in Yokohama caused by a wheel that detached from a truck of Mitsubishi Motors Corp.(TSE 1st:7211,web), which spun off its truck and bus operations into MItsubishi Fuso Truck and Bus Corp. in January 2003.
